Employing a descriptive-interpretive qualitative design, it was grounded in Jaap Paauweโs Contextually Based Human Resource Theory and strongly aligned with the ๐๐ฃ๐๐ฉ๐๐ ๐๐๐ฉ๐๐ค๐ฃ๐จ ๐๐ช๐จ๐ฉ๐๐๐ฃ๐๐๐ก๐ ๐ฟ๐๐ซ๐๐ก๐ค๐ฅ๐ข๐๐ฃ๐ฉ ๐๐ค๐๐ก๐จ (๐๐ฟ๐๐จ)โparticularly ๐๐ฟ๐ 8 (๐ฟ๐๐๐๐ฃ๐ฉ ๐๐ค๐ง๐ ๐๐ฃ๐ ๐๐๐ค๐ฃ๐ค๐ข๐๐ ๐๐ง๐ค๐ฌ๐ฉ๐) and ๐๐ฟ๐ 16 (๐๐๐๐๐, ๐ ๐ช๐จ๐ฉ๐๐๐, ๐๐ฃ๐ ๐๐ฉ๐ง๐ค๐ฃ๐ ๐๐ฃ๐จ๐ฉ๐๐ฉ๐ช๐ฉ๐๐ค๐ฃ๐จ).
Through Braun and Clarkeโs thematic analysis and Krippendorffโs content analysis, the research identified five themes shaping employee-employer relationships: selection and engagement, capacity to dismiss, employerโs authority over work practices, payment of wages, and economic dependence. It further highlighted three essential areas of employment practices: termination, discipline, and evaluation.
The study also examined the philosophical orientations of judicial decision-makersโranging from legal realism to textualism and constructionismโdemonstrating how these perspectives influence labor rulings and interpretations. Using Dedoose software and validated through Cohenโs Kappa, the analysis culminated in the creation of the ECJ (Evidence-Informed, Contextualized, and Justice-Oriented) HR Policy Framework. This framework offers jurisprudence-based strategies to strengthen HR practices, ensuring fairness, compliance, resilience, and social justice within organizations.
Dr. Eufan stressed that the study has practical value for HR professionals, policy-makers, labor advocates, and technology developers, bridging legal precedents with workplace policy reforms. By integrating insights from jurisprudence into organizational management, the research contributes to advancing decent work, equitable treatment, and sustainable labor practicesโcore commitments of the SDGs.
Her presentation was part of the seven-member NDDU research delegation to the HCU International Conference under the theme โ๐๐๐จ๐๐๐ง๐๐ ๐ฉ๐ค ๐๐๐ง๐ซ๐ ๐๐ค๐๐๐๐ฉ๐ฎโ. The delegation reflected NDDUโs continuing dedication to international academic collaboration and research-driven solutions to pressing global challenges.
